Article 2 – Purpose and scope

These Terms set out the rights and obligations of ROYALCIG and the customer in connection with distance sales of the products offered on the website.

They apply to orders placed by consumers, namely individuals acting for purposes outside their trade, business, craft, professional or agricultural activities.

Customers are invited to read these Terms before placing an order. Confirming an order entails acceptance of the Terms under the conditions specified during checkout.

Article 3 – Vaping products and age requirement

Under French law, the sale or free supply of vaping products to persons under the age of 18 is prohibited.

By ordering a vaping product on the RoyalCig website, customers declare that they are at least 18 years old. ROYALCIG reserves the right to request proof of legal age in accordance with applicable regulations.

If the customer cannot establish their legal age when proof is required, the sale of the product concerned cannot proceed.

Article 4 – Product characteristics

ROYALCIG describes the essential characteristics of the products offered for sale so that customers can review them before ordering.

Product photographs and illustrations are intended to represent the items as faithfully as possible. However, they do not replace the characteristics and information provided on the product page.

In particular, customers must check the compatibility of accessories, coils, batteries, clearomisers or other components with their equipment before use.

Article 5 – Availability

Products are offered subject to availability.

If a product becomes unavailable after an order has been confirmed, ROYALCIG will inform the customer as soon as possible and, depending on the circumstances and with the customer’s consent, offer an appropriate solution or a refund for the unavailable product.

Article 6 – Prices

Prices displayed on the website are stated in euros, inclusive of all taxes (VAT included), unless otherwise indicated.

Delivery costs are not necessarily included in the displayed product price. The amount is communicated to the customer before final confirmation of the order.

ROYALCIG may change its prices at any time. However, products are invoiced at the price applicable when the order is confirmed, subject in particular to an obvious pricing error.

Article 7 – Orders

Customers select the products they wish to purchase and add them to their shopping basket.

Before finally confirming an order, customers can review the basket, selected products, quantities, total price and information needed for delivery, and correct any errors.

An order becomes final after completion of the steps provided on the website and validation of payment, subject to ROYALCIG accepting the order.

Order confirmation is provided to the customer on a durable medium, in particular by email.

ROYALCIG may refuse or cancel an order for a legitimate reason, including fraud or attempted fraud, a payment incident, inability to establish legal age where legally required, or an order of a manifestly abnormal nature.

Article 8 – Payment

Orders are paid for by bank card through the secure Systempay payment solution.

Banking information required for payment is processed by the secure payment solution and is not intended to be stored by ROYALCIG in the form of complete bank card numbers.

An order will only be dispatched after payment has been successfully validated.

Article 9 – Delivery

Products are delivered to the address provided by the customer when placing the order.

Several delivery methods and carriers may be offered, depending in particular on the destination, order characteristics and available transport services.

The available delivery methods, their charges and delivery information are presented to customers before final confirmation of their orders.

ROYALCIG prepares and dispatches orders within the timeframes communicated to customers. Where no specific timeframe has been agreed, delivery will take place no later than the deadline prescribed by applicable law.

Customers are responsible for the accuracy and completeness of the address and delivery information provided when ordering.

Article 10 – Receipt and transport

Upon receipt of an order, customers are invited to check the condition of the parcel and products.

If a parcel is visibly damaged or an irregularity is found, customers are invited to make appropriate reservations with the carrier and contact ROYALCIG promptly to facilitate handling of their complaint.

These steps do not deprive consumers of their statutory rights and guarantees.

Article 11 – Right of withdrawal

Online withdrawal form: You may notify RoyalCig of your decision to withdraw using our online withdrawal form. Once your request has been recorded, you will receive a reference number and an acknowledgement by email.

Under the French Consumer Code, consumers generally have fourteen (14) days from receipt of the goods to exercise their right of withdrawal, without having to give reasons.

For an order comprising several goods delivered separately, the withdrawal period starts in accordance with the conditions laid down by applicable law.

To exercise the right of withdrawal, consumers must inform ROYALCIG of their decision using the withdrawal facility provided on the website or any other unambiguous statement of their intention to withdraw, in accordance with the law.

Consumers may also use the model withdrawal form at the end of these Terms.

Article 12 – Returns following withdrawal

After communicating their decision to withdraw, consumers must return the products concerned without undue delay and no later than fourteen (14) days after that communication.

Returns must be sent to:

ROYALCIG – Online Returns
81 boulevard d’Alsace Lorraine
64000 Pau
France

The direct costs of returning products when exercising the right of withdrawal are borne by the consumer.

Consumers are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and proper functioning, in accordance with statutory provisions.

Article 13 – Exceptions to the right of withdrawal

The right of withdrawal cannot be exercised in circumstances specified by law.

In particular, it may be excluded for goods unsealed by the consumer after delivery that cannot be returned for reasons of health protection or hygiene, provided that the statutory conditions for this exception are met.

This exception is not automatically applied to all products sold by ROYALCIG. Its applicability depends on the nature of the product and the conditions laid down by law.

Article 14 – Refunds following withdrawal

Where the right of withdrawal is validly exercised, ROYALCIG refunds the amounts due in accordance with the French Consumer Code, including standard delivery charges where required by law.

The refund is made no later than fourteen (14) days after the date on which ROYALCIG is informed of the consumer’s decision to withdraw.

For sales of goods, ROYALCIG may defer the refund until it has received the products back or the consumer has supplied evidence of having sent them back, whichever occurs first.

Refunds are made using the same payment method used for the original transaction, unless the consumer expressly agrees to another method that entails no charges.

Any additional costs resulting from the consumer choosing a more expensive delivery method than the standard delivery option offered are not refunded where permitted by law.

Article 15 – Statutory guarantee of conformity

Products sold by ROYALCIG benefit from the statutory guarantee of conformity provided for in Articles L.217-3 et seq. of the French Consumer Code.

Consumers have the rights provided by law where goods do not conform. Subject to the applicable legal conditions, they may in particular request repair or replacement and, in certain circumstances, a price reduction or termination of the contract.

Bringing goods into conformity is carried out at no cost to the consumer under the conditions prescribed by law.

For goods, consumers benefit from the statutory guarantee of conformity for the period prescribed by applicable legislation, in particular two years from delivery for new goods.

Article 16 – Guarantee against hidden defects

Consumers also benefit from the statutory guarantee against hidden defects under Articles 1641 et seq. of the French Civil Code.

Where the statutory conditions are met, consumers may exercise the rights provided by these provisions.

Statutory guarantees apply independently of any commercial or manufacturer’s warranty.

Article 17 – After-sales service and complaints

For questions about an order, product, delivery or warranty claim, customers may contact ROYALCIG:

By telephone: 05 64 64 83 48
By email: royalcig@hotmail.fr
By post: SAS ROYALCIG – 81 boulevard d’Alsace Lorraine – 64000 Pau – France

Customers are invited to provide their order number and any information needed to identify and process their request.

Article 18 – Liability

ROYALCIG is responsible for the proper performance of its obligations under the conditions prescribed by applicable law.

However, ROYALCIG cannot be held liable for misuse of a product, failure to comply with the manufacturer’s instructions, use incompatible with the equipment’s characteristics, or modification of a product by the customer, where such circumstances caused the alleged damage.

Nothing in these Terms is intended to exclude or limit any mandatory rights enjoyed by consumers.

Article 19 – Personal data

Personal data required to manage orders, payments, delivery and customer relations is processed in accordance with applicable data protection regulations.

Further information about processing operations, their purposes, retention periods and data subjects’ rights is provided in RoyalCig’s Privacy Policy.

Article 20 – Intellectual property

Elements of the RoyalCig website, including texts, photographs, graphics, logos and other content, are protected by intellectual property laws, subject to any rights held by third parties.

Any unauthorised reproduction or use is prohibited in accordance with applicable law.

Article 21 – Consumer mediation

In the event of a dispute, consumers are invited first to submit a complaint to ROYALCIG to seek an amicable solution.

After first contacting ROYALCIG, and where the statutory conditions are met, consumers may use the services of the consumer mediator to which ROYALCIG is affiliated, free of charge.

The contact details of the competent consumer mediator will be published in this section once ROYALCIG has appointed one.

Article 22 – Applicable law and dispute resolution

These Terms are governed by French law, subject to any mandatory provisions that may apply to the consumer.

In the event of a disagreement, the parties are invited to seek an amicable resolution before commencing legal proceedings.

If no amicable solution is reached, consumers may bring proceedings before the competent court in accordance with applicable legal rules.

Article 23 – Amendments to the Terms

ROYALCIG may amend these Terms, particularly to reflect legislative, regulatory, technical or commercial developments.

The Terms applicable to an order are those accepted by the customer when that order was placed.
